犯罪事实分类在刑事审判活动中具有重要价值。无论是传统的单一分类还是现有的层级分类都不能满足犯罪事实分类精细化的要求。合理的犯罪事实分类应当在最高人民法院2014年《量刑指导意见》层级分类的基础上以系统论思想为指导,认真研究各个犯罪事实的性质、作用层次和关系,在功能视野下对整个犯罪事实进行立体、全面的分析与分类。

Classification of crime facts has great value in the criminal justice activities. Both tradi tional single classification and the existing level classification can not meet the requirements of in- tensive classification of the crime facts. Reasonable classification of crime facts should be based on the level classification of the Guiding Opinions on Sentencing by the Supreme People＇s Courts （2014）, and guided by the system theory, so we should seriously study the nature, the role hier- archy and relationships of each crime fact and make a three-dimensional and comprehensive analy- sis and classification of the entire crime facts from the functional perspective.
