白裤瑶婚姻习惯法作为一项地方性知识,已经被民众普遍接受并成为其生活准则的重要组成部分。本文从婚约、结婚、离婚等方面描述了传统婚姻习惯法,并在此基础上分析了习惯法与国家法冲突的具体表现及原因,并从观念层面、立法层面及司法层面提出建议,以期实现白裤瑶婚姻习惯法与国家法之融合。
白褲瑤婚姻習慣法作為一項地方性知識,已經被民衆普遍接受併成為其生活準則的重要組成部分。本文從婚約、結婚、離婚等方麵描述瞭傳統婚姻習慣法,併在此基礎上分析瞭習慣法與國傢法遲突的具體錶現及原因,併從觀唸層麵、立法層麵及司法層麵提齣建議,以期實現白褲瑤婚姻習慣法與國傢法之融閤。

As an important part of local knowledge, the Bai Ku Yao＇ s matrimonial customary law has been popular and become important component of their living standards. Based on the description of the tra- ditional matrimonial customary law in terms of engagement, marriage, and divorce, this article analyses the specific manifestations and causes of conflict between the matrimonial customary law and the national law, and puts forward some suggestions from the concept level, the legislative level and judicial level in order to realize fusion between the Baiku Yao＇ s matrimonial customary law and the state law.
