民事执行检察监督是化解“执行难”和“执行乱”的有力制度设计。2012年新《民事诉讼法》为民事执行检察监督确立了法律依据,但民事执行检察监督制度远未建立。民事执行检察监督制度应当着重围绕监督范围、方式和具体程序来合理建构。民事执行检察监督的方式主要包括抗诉、发出纠正违法通知或者检察建议、提出暂缓执行建议以及加强执行责任追究等。民事执行检察监督制度是一项系统工程,借助人大、政协及社会舆论监督制度来防范检察监督权的滥用问题也应当是民事执行检察监督制度的必然命题。

The system of procuratorial supervision on civil execution is a powerful design to resolve the phenomenon of ＂chaos and difficulties of execution＂. The procuratorial supervision on civil execution has been stipulated by the new Civil Procedural Law in 2012. However, the system of procuratorial supervision on civil execution is far from established. The system should focus on the reasonable construction of scope, mode and the specific procedures. The mode of civil execution procuratorial supervision mainly includes the protest, notice of correct illegal, procuratorial advice or recommendation of reprieve etc. Civil execution procuratorial supervision system is a systematic project, and it＇s an inevitable proposition to guard against abuse of procuratorial supervision with the aid of supervision by National People＇s Congress, Chinese People＇s Political Consultative Conference and the social public opinion.
