伽达默尔的哲学解释学,以分析游戏为切入点,论证了在艺术领域,解释是真理生成的基本方式。他把这一结论扩展到整个人文社会科学领域,认为在这些领域,真理的生成不适合采用自然科学的实证方法,而应采取解释的方式,即解释者与文本之间进行对话式互动整合,从而达到视域融合。他还从解释学的角度阐释了法律解释的主要特征。现行中国法律解释存在许多问题,应借鉴伽达默尔解释学原理,进行深度改革和总体整合,使之适合法治发展的需要。

Gadamer＇s philosophical hermeneutics,in the perspective of the nature of game,demonstrates that the process of understanding and interpretation is the basic mode of generating truth in the field of arts.He extended the conclusion and suggested that the conclusion be applicable to the all disciplines of the humanities and social sciences. He held that the generation of truth in these fields is different from natural sciences which use the positive methods,and should adopt the principles of hermeneutics,integrating the interactional conversation between the texts and interpreters,to achieve the fusion of horizons. He also analyzed the main characteristics of legal interpretation from the perspective of hermeneutics. There are number of debates over the issues of the current legal interpretation in China. The Chinese legal interpretation will be improved greatly and will fit to the necessity of the rule of law if it could be reformed and integrated by using the theory of Gagamer＇s hermeneutics.
