目前中国律师的辩护活动并非以说服裁判者接受其辩护意见为目标。这种带有＂表演＂性质的辩护,称之为＂表演性辩护＂。根据律师的行为方式及其与公安司法机关的关系,＂表演性辩护＂可以分为＂配合性表演＂和＂对抗性表演＂两种模式。造成律师辩护＂表演化＂的主要原因是,刑事庭审的空洞化和刑事审判权的异化,辩护律师的执业环境依然没有得到明显的改善,辩护律师不尽职责的情况也时有发生,等等。解决律师辩护＂表演化＂的关键是,在遵循司法规律的基础上,继续改革和完善中国的刑事审判制度乃至司法制度。此外,还应针对辩护律师构建起特殊的保护机制和符合中国现实情况的质量控制标准与机制。

Currently in China,defense lawyers usually do not aim at persuading judges. Instead,such defense has a showing character and is called‘defense with characteristics of performance ＇in this article. It is classified into cooperative performance and confrontational performance according to attorneys＇ behavioral modes and their relationships with the public security and judicial organs. The main reasons for the frequent appearance of such defense with characteristics of performance include that： the hollowing out of criminal court hearing and the heterization of criminal judicial power,no obvious improvement of defense lawyers＇ practicing environment and the occasionally undutiful fulfillment of defense lawyers. Thus,the essential resolution to this problem is to insist on reforming and perfecting China＇s criminal judicatory and even judicial system according to judicial disciplines. In addition,it is necessary to build special protection mechanism for defense lawyers,and establish the quality control standard and the relevant mechanism that match China＇s reality.
