香港特别行政区法院审理香港基本法相关案件大量援用域外法律,有的学者称之为＂宪法国际化＂的一个例证。＂宪法国际化＂成为香港突出的司法现象。香港作为一个普通法传统的地区,基本法授权香港法院参考其他普通法适用地区的司法判例,但＂参考＂是不具有约束力的。香港法院将域外法律奉为权威,并作为法律依据予以适用,超越了＂参考＂的限度。在全球化的大背景下,域外法律对基本法权利的发展和解释产生一定的影响,香港法院裁判基本法相关案件参考域外法律是必要的,但在援用域外法律时需要限定在基本法授权的范围内,并遵循一定的规则和条件,减少任意性,突出香港司法解释的自主性。

The courts of Hong Kong Special Administrative Region use a lot of foreign materials in the adjudication of Hong Kong basic law cases which often cited as an example by the academics as a proof of internationalization of constitution. The internationalization of constitution is a highlighted judicial phenomenon. As a region with common law tradition,Hong Kong＇s courts are authorized by Basic Law to refer to precedents of other common law jurisdictions. But ＂reference＂does not mean binding force. The courts using foreign materials as authority exceeds the limit of reference Basic Law permitted. With the background of globalization,foreign materials have some influences on the interpretation and development of the rights guaranteed by Basic Law,it is necessary to refer to the foreign materials in the adjudication of Basic Law cases,but the citing should be defined by Basic Law and follow the rules and guideline so as to avoid the arbitrariness and develop Hong Kong judicial autonomy.
