西方经济法的产生旨在授予政府干预经济的权力,但这并不适于解决当下的中国问题。行政权力过于庞大并日渐扩张的态势必然要求经济法予以有效回应,控权应当成为中国经济法的主旨。不论从法的一般属性,还是从经济法的独有特征来看,控权都能够与之兼容。我国经济法的现有制度虽有对控权功能的文本表达,但仍然不够,与法治经济实现的要求亦相去甚远。虽然行政法也以控权为己任,但其与经济法在控权对象和违法性审查标准等方面存在明显差异,只有将二者有机结合才可以形成对政府权力的有效控制。

The origin of Western Economic Law is aimed at authorising the government to intervene economy. It is,however,not appropriate to solve Chinese problems. The huge administrative power and its gradually expanding trend require effective response from Economic Law. Power control should thus become the keystone of Economic Law. No matter from the general nature of law,or from the unique feature of Economic Law,power control is compatible with Economic Law. Although our current system of Economic Law has some expressions on the function of power control,it is not sufficient and far away from the requirement of realizing economy under the rule of law. In spite of Administrative Law also aims at controlling power,it differs greatly from the Economic Law in the objectives of power control and the standard of illegality censorship. Only proper integration of Economic Law and Administrative Law can form an effective control of the government power.
