学界对宋代审判制度及赦降制度已有充分研究,而对死刑数据尚有许多混淆。宋代＂刑不滥施,死无冤人＂的死刑执行方针是以唐代贞观年间两位数的死刑执行数目为标准调控的。程序上需要奏裁的案件承担了宋代降低死刑执行数量的重任。人命至重的价值观、对高额死刑数量的忧虑、死刑制度的微调,这三者在君臣的死刑制度对话中形成了不断互动。从而使宋代死刑执法这一行动中的法律能够不断在正义与怜悯、正义与效率之间的平衡被校准,避免了死刑制度僵化和滥用。

The adjudication and amnesty system of Song dynasty has been thoroughly researched by the academia,but the actual number of the annual death penalty has not been determined convincingly hitherto because the insufficient and confused historical records. No innocent person get executed＇policy of the Song was based on the double- digit capital punishments record of the Zhenguan of Tang,and the execution number was adjusted accordingly. As a special procedure,Zoucai（ request for judment）,had been used to reduce the death penalty number,The value of the importance of human life,the concern of excessive execution and the trimming of capital punishments regime formed interaction between the emperors and their officials on the conversation about death penalty,which made the law of executing capital punishments in Song dynasty stroke a nice balance among justice,efficiency and mercy,and avoid rigidity and abusing.
