我国的惩罚性赔偿制度并不完全等同于英美法系现代的惩罚性赔偿制度。应从我国法际差异和法际协调的角度,具体统一惩罚性赔偿制度的理论定位和适用条件、适用范围,形成比较合理的制度体系。作为连接公法和私法领域的有益桥梁,惩罚性赔偿的适用不应局限于某一特定的法律部门。宜进一步限缩＂故意＂中可以适用惩罚性赔偿的范围,宜＂以引起他人损害为直接目的＂,即需具备主观恶意,,才适用惩罚性赔偿。在惩罚性赔偿的计算方法上,应区别不同情况作出规定。新修订《消法》第55条中＂法律另有规定的,依照其规定＂建议修改为＂法律另有较高赔偿规定的,依照其规定＂。面对惩罚性赔偿制度的缺陷,可以通过利益收缴等方式予以弥补。

China＇s punitive damages system are not completely equivalent to the modern Anglo-American law system＇. We should analyze the differences between punitive damages and promote the coordination of punitive damages. From the applicable conditions and scope,we improve the system of punitive damages in our country and form a scientific reasonable theory system and legal system. As a valuable bridge connecting the public law and private law field,the application of the punitive damages should not be limited to a specific legal department. The subjective aspect of punitive damages should be limited in evil intentions. On the calculation method of punitive damages,it is necessary to make different provisions according to the different situations. In the article 55 of the newly revised Law of the PRC on. The Protecfion of Consumer Rights and Interests,the compensation should be combined to the high standard if the other law has different stipulation. In the face of the defects of the system of punitive damages,we can make up through the interests collection,etc.
