突破理论思辨的研究范式,将犯罪论体系的研究置于刑事诉讼实务中考察就会发现,由于立案、侦查、起诉、审判各诉讼阶段特点和任务的不同,具体的定罪思路也会存在较大差异。而无论是阶层式犯罪论体系还是四要件犯罪论体系,均只设定了一种较为固定的定罪思路,因此,难以完全与刑事诉讼中各个阶段的具体定罪思路相契合。相较而言,基于四要件犯罪论体系平面整合式的特点,四要件犯罪论体系与刑事诉讼中的定罪思路契合度更高。因此,从诉讼实务角度来看,四要件犯罪论体系更具合理性。
突破理論思辨的研究範式,將犯罪論體繫的研究置于刑事訴訟實務中攷察就會髮現,由于立案、偵查、起訴、審判各訴訟階段特點和任務的不同,具體的定罪思路也會存在較大差異。而無論是階層式犯罪論體繫還是四要件犯罪論體繫,均隻設定瞭一種較為固定的定罪思路,因此,難以完全與刑事訴訟中各箇階段的具體定罪思路相契閤。相較而言,基于四要件犯罪論體繫平麵整閤式的特點,四要件犯罪論體繫與刑事訴訟中的定罪思路契閤度更高。因此,從訴訟實務角度來看,四要件犯罪論體繫更具閤理性。

Breaking through the speculative research methods and investigating criminology theory system in criminal proceedings,we will find that the specific conviction thinking will be quite different based on the filing,investigation,prosecution and the trial＇s different characteristics and tasks.So whether it is regarded as a hierarchical system,or quaternary criminal theory system,only a relatively fixed conviction thinking model is presupposed,and therefore it is difficult to adapt to the various stages of the criminal proceedings.In contrast,based on the quaternary criminal theory system＇s planar integrated features,it is sure that the conviction thinking in criminal proceedings is more suitable.All in all,considered from the perspective of criminal procedural practice,the quaternary criminal theory system seems to be more rational.
