IPAD商标案凸显商标侵权使用人能否享有其创造的商标价值增殖权益问题。对此,新商标法无规定,学界无回应,侵权使用人也仅留下“为他人作嫁衣裳”的叹息。经研究发现,故意侵权的商标使用人无权享有其创造的商标增殖权益,但是,善意侵权或过失侵权商标使用人享有该权益具有法理依据。建议我国商标法增加、完善商标使用人享有其创造的商标价值增殖权益的条款。

IPAD trademark case concerns whether the trademark infringement user can enjoy the appreciation of the trademark value created by himself. There is neither a provision in new Trademark Law nor a response from academia. The infringement user only can sigh "made a wedding dress for others". Researches show that the intentional infringement user cannot share the appreciation of the trademark value created by himself However, if the infringement action is innocent or negligent, the user can legitimately share the rights and interests with a legal basis. Thus, this article suggests adding and perfecting the clause in our Trademark Law that the trademark user can share the appreciation value of the trademark created by himself.
