新中国成立至今我国土地制度经历了几度变迁后仍然存在权利行使方面的缺憾。针对如何排除行使农村集体土地所有权的障碍,提出农村集体土地所有权制的完善应在坚持集体所有的前提下进行微观改造;从对我国农村集体土地所有权性质的定性分析中得出对集体概念的理解,并就土地权能的完善提出建议。最后提出应赋予我国农民集体以独立法律人格并完善相关权利行使方式来解决相关问题。

The rural collective land is the farmers＇ basic means of production.Changes since the founding of new China have not yet effectively overcome the drawbacks in exercising rural collective land ownership.To help disencumber the constraints and make full use of the rural land ownership,this paper discusses the choice of the rural land ownership between collective ownership,nationalization and privatization from a macroscopic angle.It also explores ways to cope with the problems encountered in adhering to this choice from a microcosmic angle.An understanding of the nature of rural land ownership helps define the concept of collective ownership and consummate the state of right. To sum up,all the questions above can be solved by giving an independent corporate personality to famer collectives and improving relevant rights.
