作为法治建设新十六字方针内容的科学立法的提出契合了中国特色社会主义法律体系形成的现状，抓住了我国立法领域的主要矛盾，具有很强的针对性。所谓科学立法，是指立法活动作为立法者有目的、有意识的自觉活动，在充分认识和尊重事物发展的客观规律的基础上，准确回应现实社会生活关系的客观立法需求，从而实现主观与客观的统一。法治建设新十六字方针没有突出民主立法，这并不意味着是对民主立法的削弱，更不是对民主立法的否定。而且，就科学立法的实现而言，民主立法的作用也是应予肯定的。
