基于继承而发生的物权变动可划分为两个阶段,即遗产由被继承人移转至共同继承人共有的第一阶段,遗产由共同继承人共有至各共同继承人单独所有的第二阶段。前者与各国所采取的继承样态有关,而后者则与遗产分割的效力模式息息相关。遗赠能否与继承同样看待从而使遗赠之标的物于遗赠开始时即当然移转于受遗赠人,与各国所采取的遗赠制度之立法模式及物权变动模式息息相关。在我国现行立法采＂区分遗嘱继承与遗赠＂及＂形式主义物权变动模式＂之框架下,遗赠仅具有债权效力而不具有直接导致物权变动之物权效力。

Property rights alteration based on the inheritance can be divided into two stages,the first stage is from the decedent transferring to the co-successor to form a joint ownership and the second stage is from the co-heirs co-ownership to separate ownership. The former is related to the inheritance pattern,but the latter relates to effect model of division of inheritance. Whether the demise could be treated in the same view as the inheritance which the legacy immediately is bequeathed to legatee from the start of the demise is closely linked with the model of the demise and real rights alteration accepted by various countries. Legacy has only the effectiveness of claim without having to directly lead to real rights alteration. The framework of the present legislation of our country takes distinguishing the testamentary succession and demise and the formalism model of real rights alteration.
