通过宪法的权利保障来防止国家权力的恣意，以维护民众的切身利益，是宪法得以产生和维系的基础。随着行政国家时代的到来，行政对国家事务的参与力度与广度都是前所未有的，社会抚养费征收与上户口相捆绑的做法在地方上普遍存在。从宪法的权利保障功能的角度探讨征收社会抚养费与上户口相捆绑的过程中形成的国家权力配置问题，有助于反思政府行政管理上不足。在我国宪法对人民权利保障功能还需加强，对政府的监督功能还需强化的情况下，将社会抚养费与上户口脱钩，加强对政府工作的宪法监督，从根本上实现人民的权利应成为首选途径。在此基础上，宪法才能真正成为人民权利的保障，拥有宪法的权威。
