引经折狱又名春秋决狱,是形成于汉代的一种司法方法。它以儒家经义（主要是《春秋》）作为评判案件的依据,强调原心定罪,在中国司法史上一度流行并影响深远。以现代眼光来看,运用西方盛行的本体论诠释学可以使这一中国古代的司法方法被更好地接受与理解。具言之：引经折狱的断案过程,可以视为司法官与立法者的两种不同的法律观点之间的视域交融;司法官为寻求裁判的合法性与合理性依据,往往求助于特定历史背景下对典故的解释;在引经折狱中,汉儒的主体性与实在性得到了彰显并同历史情境之间产生了互动。

Judging Cases by Confucian classics is a judicial method formed during Western Han Dynasty.It treats Confucian classics,especially The Spring and Autumn Annals as a criterion of judgment,which puts emphasis on the defendant′s motive.Judging Cases by Confucian classics has a far-reaching influence on the development of Chinese legal history.From the viewpoint of this article,the methodology of Ontological Hermeneutics can be used to discuss this phenomenon.Firstly,it can be deemed as a way of fusion of two different horizons,which belong to judges and lawmakers respectively.Secondly,when arguing for the legality and rationality of a judgment,the judge always resorts to historical allusions and traditions.Finally,the subjectivity and substantiality of Han Confucians are demonstrated in this process,which contributes to the interaction between the subject and historical context.
