由于农民在集体所有权中享有的权利不清晰、农民在集体财产中的成员权以户籍为标准确定，导致落户城镇后农民享有在集体财产中的权益存在制度障碍。户籍改革的顺利进行要求不能损害进城农民在农村的产权权益，为此要改造农民集体所有权制度和集体收益分配权制度。集体所有权的初衷是维护每个集体成员的利益，因此要虚化集体在权利主体中的地位，将集体财产所有权中更多的权能直接赋予农民。而农民在集体财产中的收益分配权要设计成与户籍相脱离的独立权利，并构建专门的实现和救济制度。

As the unclear the farmer＇ s rights in the collective ownership are, meanwhile, the members rights in the collec- tive property are depending on the household registration, system obstacles still exist when farmers enjoy basic rights in the collective property. Household registration reform cannot being placed on the basis of migrant farmers＇ rights. Hence, the peasants collective ownership system and the collective income distribution right system need to be reformed imperatively. The original intention of collective ownership is to maintain the interests of the members of each group, and collective＇ s status in the right main body must have been blurred, which would directly provide more empowerment in collective property ownership to farmers. The income distribution right of farmers in the collective property should be designed in independent rights which separate from the domicile, and build special implementation and relief system as well.
