“错法”系难以服务于经济社会发展大计、脱离生产生活实际或者违背社会主流价值的法。“错法”现象在经济法领域尤为严重。经济法中的“错法”缘于经济关系复杂多变，主观的法律规范未能适当地反映客观的规律和要求，而难以与社会中的经济系统和非经济系统有效地沟通和互动。由于具体错因不同，错法有多种类型。面对经济法中的“错法”，可以用法律评估、民主立法、问责制和违宪审查等方法来发现并改正它。

Outdated legislations refer to those failing to meet the needs of economic and social develop-ment, losing contact with reality, or going against the mainstream values in our society. They are com-monly seen in the field of economic law. Due to complex economic relations, economic law does not al-ways meet our realistic needs, leading to an inefficient interaction with economic and non-economic sys-tems in our society. Outdated laws fall into several types according to different causes for their obsoles-cence. As to outdated legislations in the field of economic law, we can identify and correct them through introducing legal assessment, democratic legislation, accountability system and judicial review.
