世界贸易组织《农业协定》框架下的农业补贴,在我国主要是指国内支持。本文通过分析《农业协定》的相关规定和我国的立法现状,结合我国农业补贴现状对立法的需求,总结欧盟改革和美国立法的经验对我国的启示,提出以下完善立法的建议：（1）采取制定一部农业补贴综合立法,辅以配套条例和细则的分层立法模式;（2）综合立法应以规定长期目标为目的,其规定应具有较高的稳定性;配套立法以实现短期目标为目的,其具体实施方案应便于修订。文章同时对若干问题提出了具体建议。

The agricultural subsidy under the framework of WTO ＂Agreement on Agriculture＂ mainly refers to domestic support in our country. By analyzing the regulations of ＂Agreement on Agriculture＂ and the current legislation in our country, presenting the legislative requirements to the reality situation of China＇ s agricultural subsidy, summarizing the experience of EU reform and legislation development in the United States ,we submitted the following recommendations to improve our legislation ：（ 1 ） adopting a hierarchical legislation model ： enacting a comprehensive agricultural subsidy legislation which was supplemented by specific regulations and rules;（2） the comprehensive legislative provisions should aim at long -term goals with high stability;supporting legislation should focus on mended easily. This paper also shortterm goals, the specific measures should be enforced effectively and adiscusses about some other specific problems.
