新修订的民事诉讼法确立了专家辅助人制度,该制度的设立为更好处理专业性较强的案件提供了新的思路。但由于立法过于简陋,给具体实践操作带来了种种难题和不稳定性。为了使该制度更好地落到实处,发挥其应有的积极作用,有必要就如何进一步完善我国的专家辅助人制度进行深入细致的分析。通过专家辅助人制度产生的实践背景、基本概念以及其与相近概念的比较;结合专家辅助人制度的立法现状以及在我国司法实践中的运用,分析了该制度存在的种种问题。对域外相关制度进行了解读与评价,通过对比分析不同法系国家的制度,强调日本的诉讼辅佐人于我国有较强的借鉴意义。进而,从专家辅助人的诉讼地位、资格认定、参诉程序、权利义务以及意见采信等方面来完善专家辅助人制度。

The 2013 revised Code of Civil Procedure deal with these highly specialized cases and provide establishes the Expert Assistant Systemin order to better a new way of thinking. But because of the legislation for the system is too simple, it brings various problems and instability. In order to make the system bettercarried out,it is necessary to analyze more on how to further improve China＇ s Expert Assistant SystemThere should be legislation to achieve its effect. Describingthe practical background of Expert Assistant System, basic concepts, as well as its comparison with the similar concept, combining with the legislative status of the rules,the paper analyzes the problems that exist in the system. Combining with the foregoing analysis, the author discusses how to improve the expert assistant system which carry out a number of auxiliary envisaged litigations involving the status of experts assisted person＇ s qualification, the suit - evolving procedures, rights and obligations and the adoption of views.
