缘何“强硬”的刑事法律在“特殊”的乡土社会变得“柔软”，难以实现其应有的实效，概因乡土社会中原有重要资源、力量和因素被我们无意遗忘或有意抛弃，职是之故，我们需要探寻合适的渠道和方法使得刑事法律真正走进这片特殊领域。新《刑事诉讼法》对刑事和解制度予以法定化，尊重和规范了广泛存在于民间的刑事私了习惯。这一举措为如何实现刑事法律实效提供诸多启示：国家机关在立法或适法时需要尊重民间习惯、倚重民间力量、考虑民众理性以及考察社会因素。否则，刑事法律在乡土社会被无视、架空和规避就不足为奇。

The reason why the ＂forceful＂ criminal law becomes ＂soft＂ and can not realize its profound efficacy of law in the rural society is that the important resources, power or factors of the rural society have been forgotten or deliberately abandoned by US o Therefore,we need to find some appropriate channels and measures so that criminal laws can really enter into this special area. The new ＂Code of Criminal Procedure＂ makes the criminal reconcilia- tion system legal, and respects and standards the private settlement of criminal cases which widely exist in the folk. This measure brings us inspiration for realizing criminal laws＇ effectiveness by indicating that state organs need to respect the folk customs, rely on folk forces, consider the people＇ s reason and inspect the social factors in legislation or law application. Otherwise, it will be factual that the criminal law is ignored, discarded and avoided in the rural society.
