家庭暴力对家庭、社会的危害是不言而喻的。在现有证据规则下,受害人的合法权益很难得到维护。文章通过五个方面,即对当事人陈述证明力提高、增加新的证据种类、对证据采信适用裁量权、降低对证据的合法性要求以及适用表见证明原则,降低受害人的证明标准,对家庭暴力案件中受害人在证据方面进行倾向性的规定,从而使家庭暴力案件受害人的合法权益得到维护。

The harm of family violence is self-evident to the family and society. Under the existing evidence rules, it＇ s hard to safeguard the legitimate rights and interests of the victim. This article suggests tendentious stipulations for victims ＇ evidence of family violence cases in five aspects, namely the increase of probative force of litigants＇ statements, addition of new types of evidence, adoption of discretionary power for the evidence admissibility, reduction of the requirement for the le- gitimacy of evidence, and application of the principle of ostensible proving, to lower the standard of proof of the victims, so that the legitimate rights and interests of family violence victims can be safeguarded.
