1997年我国对香港恢复行使主权以来，内地与香港在确立民商事判决相互认可和执行的法律制度方面取得了很大进展，然而，两地某些学者和司法人员在对民商事判决相互认可和执行的认知基础、相互认可和执行民商事判决的范围、内地法院判决的终局性和两地相互认可和执行判决中的公共秩序等问题的认识上存在着一些分歧，致使两地民商事判决的相互认可和执行的法律制度难以充分发挥其效用。因此，深入探讨解决上述问题的途径将有益于促进两地民商事判决相互认可和执行法律制度的完善和两地民商事关系的健康发展。

Along with chinese goverment has successively resumed the exercise of sovereignty over hongkong since 1997 , the mainland and Hongkong in the establish legal system of civil and commercial judgments of the mutual recognition and enforcement have made great progress, however, the cognitive foundation of civil and commercial judgments of the mutual recognition and enforcement by some scholars and judicial personnel,the scope of the mutual recognition and enforcement of judgments in civil and commercial judgments , the issues on the finality of judgment in the mainland and the mutual recognition and enforcement of judgment in the public order have some problems, resulting legal system of the judgments in civil and commercial matters of mutual recognition and enforcement of giving full play to its effectiveness. Therefore, further exploring the way to solve the above problems will be beneficial to promoting the healthy development of the two judgments in civil and commercial matters of mutual recognition and enforcement of the perfection of the legal system and civil and commercial relations.
