在专利授权、确权程序中,公知常识的认定一直是一个争议极大而又很难解决的问题。文章尝试从公知常识的基本概念入手,分析适用公知常识评价创造性时需要考量的因素以及可能存在的问题,希望以此厘清思路,提供适用公知常识的一些思路或方法,以期在一定程度上避免公知常识的滥用,确保审查工作的公正与公平。

In the process of patent grant and affirmation,determination of common knowledge has been an extremely controversial issue and very tough to settle.This paper attempts to,from the concept of common knowledge,analyze the factors which should be？considered in the application of common knowledge and the possible problems.The aim is to clarify the ideas and provide some applicable methods of common knowledge,to avoid abuse of common knowledge and to ensure the examination work more equality and justice.
