我国尚无完整专门的《核安全法》,有关核安全的法律规范散存于相关的法律文件之中,其主要问题是：专门法律缺位,效力层次低下,出台时间滞后,规范内容零散.《核安全法》的制定应依循立法程序,阐述立法的必要性与可行性,证明法案内容的合法性与合理性.《核安全法》必须设置的基本法律制度有行政许可制度、核安全信息公开制度、核安全事故处置制度、核损害赔偿制度和核安全监督制度.为了加快立法步伐、提高立法质量,《核安全法》的制定,应采用有效的立法机制、立法技术.

There is still no complete specialized nuclear safety law in our country now, the nuclear safety legal norms are scattered in the related legal documents which lead to the main problems as follows： the absence of specialized laws, low effectiveness, late legislation and scattered standard contents. The legislation of nuclear safety law should follow the legislative process, elaborate its necessity and feasibility in order to prove the legitimacy and the rationality of its legislation contents. It is necessary for the nuclear safety law to set up basic legal institutions such as administrative licensing system, nuclear safety information disclosure system, nuclear safety accident disposal system, nuclear damage compensation system and nuclear safety supervision system. In order to quicken the steps of legislation and improve the quality of the nuclear safety law, we should adopt effective mechanism of legislation and legislative technology.
