作为治理的基本要素,“共识”不同于单纯的“同意”（consent）、“治理”有异于传统的“管理”.应当以“共识导向”为基础,以民主治理为依托,探索生态法治建设的五个新思路：基于民主协商的生态共识、选举民主与“绿色法治GDP”新考评体系、社会自治与生态司法改革、谈判民主下互动式生态权益救济之道、生态法治的组织架构创新.
作為治理的基本要素,“共識”不同于單純的“同意”（consent）、“治理”有異于傳統的“管理”.應噹以“共識導嚮”為基礎,以民主治理為依託,探索生態法治建設的五箇新思路：基于民主協商的生態共識、選舉民主與“綠色法治GDP”新攷評體繫、社會自治與生態司法改革、談判民主下互動式生態權益救濟之道、生態法治的組織架構創新.
작위치리적기본요소,“공식”불동우단순적“동의”（consent）、“치리”유이우전통적“관리”.응당이“공식도향”위기출,이민주치리위의탁,탐색생태법치건설적오개신사로：기우민주협상적생태공식、선거민주여“록색법치GDP”신고평체계、사회자치여생태사법개혁、담판민주하호동식생태권익구제지도、생태법치적조직가구창신.
As the basic element, ＂consensus＂ is different from the mere ＂consent＂. ＂Governance＂ is differ- ent from the traditional ＂management＂. Based on ＂the consensus orientation＂ and dependent on the democratic governance, this paper proposes five new ideas on reforming ecological rule of law. They are the ecological consen- sus based on democratic consultation, democratic election and new assessment system of the ＂green rule of law GDP＂, social self-governance and ecological judicial reform, ecological legal remedy in an interactive way in the context of democratic negotiation and the framework of ecological rule of law.
