描述性意义上的立法理念既反映了人们对于立法的认识,又是指导立法活动的理论基础和起主导作用的价值观。透过对三十年来我国森林立法的过程和主要内容的分析,能够从法理层面归纳出其立法理念。这一理念的产生有其历史传统、政治体制以及国际背景等因素。在新的历史条件下,旧的立法理念应适应于新的变迁趋势。
描述性意義上的立法理唸既反映瞭人們對于立法的認識,又是指導立法活動的理論基礎和起主導作用的價值觀。透過對三十年來我國森林立法的過程和主要內容的分析,能夠從法理層麵歸納齣其立法理唸。這一理唸的產生有其歷史傳統、政治體製以及國際揹景等因素。在新的歷史條件下,舊的立法理唸應適應于新的變遷趨勢。

Legislative idealism in descriptive way can not only represent our knowledge about legislation, but also be the theoretical basis and prominent philosophy to guide the legislation. By analyzing the legislative process and its main content of our forestry laws in the past 30 years in China, the idea of the legislation can be induced . The birth of this idea has some elements,including its history tradition,political system and the international backgrounds, etc. the old idea of legislation will be changed to suit the new trend.
