电子病历作为电子证据在医疗纠纷中的具体化，其效力审查应侧重于原始性和完整性。受电子病历独特属性的限制，加上管理规范性不足以及患者认知度不高等主客观因素制约，其在医疗诉讼中的证据运用情况并不理想。要克服这一弊端，不仅要求法官能够娴熟运用证明责任分配规则，还要充分考虑电子病历的诸多特性。而在电子病历生成、使用环节，还应当通过强化电子病历开发者的维护责任、建立第三方机构保管制度、落实电子病历使用事项告知措施等，规范电子病历日常管理，以确保其精度和证明效力。
