夫妻婚前互负债务不因婚姻关系的缔结而混同灭失,婚姻关系存续期间,夫妻双方也有互负债务的可能与必要,诉讼时效制度仍有适用余地。然而,时效制度预设的主体对立前提与夫妻不分彼此的现实矛盾,其追求的权利效用观也与婚姻关系强调的伦理义务观抵牾,致使时效制度在婚姻关系中无法为通常完成。域外法制多将婚姻关系纳入时效完成障碍体系中,具体包括不完成和中止两种规制模式。我国诉讼时效制度未对婚姻关系做适切调整,立法层面应予以回应,可将其纳入时效中止的法定事由。

The barrier system of complete about statute of limitations in our country did not make appropriate adjustment to the marriage, legislative level should respond in the suspension of limitation.
