本文对中西法治文明的历史演进进行比较,指出与人类文明总体性质相一致,法治文明体现了人类对生活有序化和社会正义性的共同追求,但从人类社会治理模式上说,由于人类文明的不同起源和特性,导致了人类追求法治文明的不同途径和方式,从而形成不同的模式。中国法治文明的发展先后经历了先秦的礼乐文明、秦汉至明清的礼法文明和清末向现代法治文明的转型,形成了卓有特色的法治文明模式。现代西方法治虽然形成于近代,但其文明渊源和精神可以追溯到古希腊,并历经罗马帝国、中世纪和近代启蒙而发展成今天的样态,成为对人类有重大贡献和意义的法治文明模式。今天,我们应立足于现实,继续汲取西方法治文明的精华,同时亦要重视和吸收中国法治文明的独特性和历史经验,为建设具有中国特色的现代型法治国家提供必不可少的文化自信和思想资源。

On the basis of comparison of historical evolution between Chinese and western civilization of role of law , this article points out civilization of rule of law shows the common idea for order of life and justice of the society, which is in accordance with overall nature of human beings. Different origins and characters of human beings result in different kinds of ways that people pursue civilization of rule of law and shape different patterns. Chinese civilization of rule of law experienced the period of Li yue in pre-Qin , Li fa from Qin Dynasty to Qing Dynasty and the transformation in late Qing and then developed an unique pattern of civilization of rule of law. Although modem civilization formed in modem times, its origin and spirit can date back to ancient Greece, which had pas- sed through ancient Rome, Middle Ages, the Age of Enlightenment and had become a pattern with important contribution and significance to human civilization. Nowadays, we should ground on the reality and continue assimilating the essence of western civilization of rule of law, pay attention to the unique and historical experience in Chinese and try to absorb it, in order to provide cultural resources for the building of modem civilization of rule of law with Chinese characteristics.
