随着新一轮农村土地改革的开展,我国土地流转呈＂加速跑＂的态势。作为农地流转的主要模式,农地信托是破解农业金融困局的有益探索。为推动农地信托的良性发展,我们需要对农地信托法律关系的主体和客体准确定位。农地信托的主体主要包括委托人和受托人,由于我国农地信托多采取自益信托的模式,其委托人应是农村承包经营户,受托人须是符合《信托公司管理办法》规定的农地信托机构。农地信托的客体是农地承包经营权,农户作为委托人需要将农地承包经营权转移给农地信托机构。

With the development of a new round of reform of rural land, land circulation in China is sprin-ting forward.As the main mode of rural land circulation ,rural land trust is beneficial to help resolve agriculturalfinancial predicaments.To promote the healthy development of rural land trust,it is necessary to accurately po-sition the subject and object of the legal relationship of rural land trust.The former includes the client and thetrustee.Land trust can only take the trust model in which the client is the rural contracting households.The trus-tee is the rural land trust company in line with the management regulations for trust company.The latter is themanagement right of rural land and farmers, as the clients need transfer the land management right to the ruralland trust company.
