出租汽车行业由于经常发生罢运事件而成为社会关注度高的行业,表面上来看是由于油价上涨和驾驶员上缴＂份子钱＂过多而引起的,这些表象背后实际上隐藏着制度性缺失。出租汽车管理存在着经营权属性定位不明确、制度不健全和公法私法规范不协调等问题。出租汽车经营权属于公共资源配置类行政特许,是公、私法共同调整的产物,公法规范居于主导地位,是政府对公共资源进行管理的载体。私法规范具有补充性,是维护被许可人及相关权利人的合法权益的法制保障。这种行政特许在公法上具有比一般行政许可更为独特的规制要求,在私法上也超出了一般财产权的范畴,这需要我们用发展的视角对我国行政特许制度进行全新的审视,从理论研究上为出租汽车经营权管理统一立法提供支持。

The taxi industry has been a focus industry in present society because of frequent taxi strike incidents, which seem to be caused by the fact that oil price keeps rising and too much money taxi - drivers have to pay to the government. But under the surface, there is a hidden institutional deficiency actually. Concerning taxi management, there＇ re problems such as indefinite attribute and position of management fight, distempered system and incongru- ous standards between public law and private law. The taxi management fight belongs to administrative concession which falls into the category of public resources allocation. It is the result of common adjustment of public law and private law with public law playing the dominant role. Also, the taxi management fight is the cartier of government management in the field of public resources. The private law is supplementary and it serves as legal security to pro- tect the licensee and related obligee＇ s legal fights and benefits. Such administrative concession has more particular regulatory requirement than normal administrative approval in public law, and falls outside normal property fights in private law, which needs brand - new and growing visual angle to examine the administrative concession in our country and to provide support or uniform legislation on taxi management fight from theoretical research.
