刑法目的论解释的正当性,必须通过三重检验,即目的论解释的初步证成、目的论解释的深度证成以及目的论解释的结果考量,始能证成其正当性。目的论解释方法,集中体现了解释者的价值判断,因而其解释结论正当性的证成必须考虑价值判断客观化的问题,必须确认存在一个法官进行目的论解释时的价值判断空间,这需要通过初步证成来完成。通过对初步证成的分析与检讨,可以有效地提高法官确立目的的合理性,有助于刑法的正义与安定性的实现。在刑法领域进行目的论解释,应该坚持法的安定性优先,同时兼顾法的妥当性。理想的刑法目的论解释应该是形式理性与实质理性的有机统一。
刑法目的論解釋的正噹性,必鬚通過三重檢驗,即目的論解釋的初步證成、目的論解釋的深度證成以及目的論解釋的結果攷量,始能證成其正噹性。目的論解釋方法,集中體現瞭解釋者的價值判斷,因而其解釋結論正噹性的證成必鬚攷慮價值判斷客觀化的問題,必鬚確認存在一箇法官進行目的論解釋時的價值判斷空間,這需要通過初步證成來完成。通過對初步證成的分析與檢討,可以有效地提高法官確立目的的閤理性,有助于刑法的正義與安定性的實現。在刑法領域進行目的論解釋,應該堅持法的安定性優先,同時兼顧法的妥噹性。理想的刑法目的論解釋應該是形式理性與實質理性的有機統一。

Teleological interpretation of the criminal law in the legitimacy of justification must go through three tests, namely the teleology to explain the preliminary justification, teleological interpretation of the depth of the justification and teleology to explain the outcomes considered, which can justify its legitima- cy. Teleological interpretation embodies a concentrated reflection of interpreter＇s value judgment, thus its reasonable evidence of interpretation conclusions into objective value judgment must be considered. We must first confirm the presence of a judge of teleological interpretation when judging the value of space, which need the preliminary justification to complete. The preliminary justification analysis and review of justification can effectively improve the judges~ establishing the objective rationality and help the realiza- tion of justice and stability of criminal law. Teleological interpretation in the field of criminal law should adhere to the priority of law stability, at the same time balancing the justice of law. Ideal teleological inter- pretation of criminal law should be the unity of formal rationality and essential rationality.
