美欧双方在TTIP谈判中对投资仲裁上诉机制总体持开放政策,在欧盟的积极推动下,TTIP上诉机制条款值得期待。在经历多次制度探索后,国际投资仲裁体系建立更为具体的上诉机制的时机已经成熟。2012年欧加CETA为TTIP谈判提供了制度借鉴,厘定上诉机制设计在时间、层级、程序和成本四个维度上的紧张关系,且昭示了与配套措施协同推进的必要性。综合欧美双方的经济立场、及其在国际投资仲裁体系的领导地位和TTIP谈判的政策取向,TTIP很有可能纳入设计合理的上诉机制条款并被其他国家借鉴,构成未来多边上诉机制的范本。

Both US and EU are open to appellate mechanism in investment arbitration in the negotiation of TTIP which is very likely to incorporate an appellate mechanism. After multiple attempts, it is desirable to include an appellate mechanism based on CETA which highlights the four tensions in the design of such a mechanism in terms of time, hierarchy, procedure and cost, as well as the necessity of such a mechanism to coordinate with other reforming measures. Given their respective economic positions, leaderships in IIAs system and policy preferences in TTIP negotiation, the future design of appellate mechanisms in TTIP will be highly balanced and have the potentiality to serve as temples for future multilateral appellate mechanism.
