政策性金融机构在我国产生并运营已达21年之久，但从其运营的法律保障及监督依据来看，到目前为止专门的政策性金融法律仍然缺位，亟须适应各政策性金融机构加快改革发展。在立法的过程中首先需要明确的一个基础性前提性问题是，对政策性金融机构的法律地位做出适合其自身特性的科学界定，这关系到出台的法律的方向性及其对政策性金融机构的规范约束的适应性问题。而要明确政策性金融机构的法律地位须以认清其本质特征为基础。通过综合分析所有相关因素之后认为，政策性金融机构从法律地位上来讲是一种具有特殊性的公法法人．

The policy financial institutions have been operating for more than 21 years. However, from the now legal protection and authority pursuant to those, we still needed to solve some problems such as legal absence of policy finance and policy financial institutions＇ reform and development needs. We need first make clear one basic and premise question is how to scientifically define the legal status of policy financial institutions which suited to their own characteristics during the legislative process. These are related to the introduced law＇ s direction and suitability for policy financial institutions＇ con- straint specification. Therefore, it is basically to recognize the essential character of policy financial in- stitutions＇ legal status for clarity. This paper thought the policy financial institutions were a kind of public law corporation which has particularity from the legal status.
