在改革前的原有企业制度中,我国劳动者作为企业主人,其利益一直由国家来代表,因此劳动者参与制度并不发达。在逐步建立现代企业制度的改革进程中,由于法律地位的差异,即使在多边治理的框架中,劳动者参与公司治理的力度和作用也不大,在市场经济体制下,我国劳动者承受着巨大的风险和压力,他们在公司中的地位和权益,亟待通过建立各项法律制度予以加强和保护。而劳动者参与公司治理的法律制度,正是提高劳动者在公司中的法律地位、维护劳动者在公司中的合法权益的有效制度。

In the original enterprise system before the reform, as the business owners, the laborers of our country have got their interests represented by the state, for which the participating system for the laborers is not devel- oped. In the reform process of gradually establishing a modem enterprise system and because of the different le- gal status, the participation of the laborers in the corporate governance doesn＇ t have big magnitude and effect, even in the framework of multilateral governance. Under the market economy system, the laborers of our country are under tremendous risks and pressures, therefore, their status and rights in the company have to be strength- ened and protected by establishing all - round legal systems. And the legal system for the laborers to participate in the corporate governance, is just the effective system to raise the workers＇ legal status and protect their law- ful rights and interests in the company.
