现行劳动立法对同工同酬的含义并未给出严格而明确的解释,导致司法机关对同工同酬的认定标准不一,加之劳动者的编制身份障碍及其承担了较重的举证责任,使该项权利有非权利化倾向。淡化对劳动者编制的司法审查不仅契合立法之规定,而且符合经济发展之趋势。同工同酬之"工"的内涵从工作岗位扩展到工作价值,"酬"的界定不宜过宽。在举证责任的分担上,由用人单位负主要举证责任,劳动者对基础事实负举证责任,使同工同酬权得到切实保障。

There is no strict and definite interpretation of the meaning of equal pay in the executory labor legislation, causing inconsistency of the identification standard towards equal pay among the judiciary. Together with the impediment of the establishment of a laborer and a heavy burden to prove, the right of equal pay tends to manifest a departure from a legal right. It is consistent with the law and the economic trend to dilute judicial review of the establishment of the laborer. And the connotation of work relating to equal pay can be the value of a work while the definition of pay when dealing with the allocation of the burden to extended from the place of a work to can not be so wide. What's more, prove, an employer should take the main burden and a laborer is supposed to prove the basic fact about the case, in order to protect the right of equal pay
