从法治思维的视角来审视,新《刑事诉讼法》设立的羁押必要性审查制度,完全契合法治思维,体现了法治规律和法治本质。从我国法治进程和法治方向的视角来审视,羁押必要性审查工作应朝着常态化、实质化和司法化的法治轨道运行发展。当前检察机关的羁押必要性审查工作还处于起步阶段,存在不少的问题和缺陷,检察机关应善于运用法治方式,建立健全制度机制,促进羁押必要性审查优化升级,以进一步尊重和保障人权,有效维护司法公正。

Seen from the perspective of the rule of law, the detention necessity censorship established in the New Criminal Procedure Law 2012 completely agrees with the rule and nature of the rule of law. In the process of the rule of law, normalization, substantiation and judicialization are the future of detention necessity censorship. As there are quite a few questions and demerits in the present detention necessity censorship, the people＇s procuratorates should fully carry out the rule of law, establish and perfect the system, optimize and update the detention necessity censorship to further respect and protect human rights and maintain judicial justice.
