非物质文化遗产法律保护中文化权利与知识产权的冲突主要体现为保护主体、保护期限、新颖性要求等方面的冲突。当今世界知识产权与文化权利的冲突越发越激烈。解决文化权利与知识产权的冲突对于非物质文化遗产的法律保护具有重要意义,解决二者冲突的基本路径在于坚持文化权利的＂适度＂优先原则和构建惠益共享制度。

Conflicts between intellectual property and cultural rights in the legal protection for intangible cultural heritage mainly reflect some conflicts, such as subjects of protection, period of protection, novelty and so on. And these conflicts are getting more and more intense. It is important to protect intangible cultural heritage to resolve these conflicts. The key path to solve conflicts between intellectual property and cultural rights is to adhere to culture ＂moderate＂ priority principle and to establish benefit sharing system building.
