在证明责任论中,证明责任的概念是基础中的基础。证明责任论从＂严禁入内＂的动荡年代到＂备受关注＂的兴起时代,走过了艰难的路程。然而,学术研究中的证明责任概念还没有得到十分明确,目前已经出现证明责任论研究较少的现象。证明责任中隐含很多相对独立的概念,这些概念的模糊性已经影响证明责任论的长足发展,更是严重影响司法审判的公正性。通过对证明责任的本质、意义与作用的分析与研究,把隐含在证明责任概念中的所有的独立现象逐一明确并在诉讼中重新定位。
在證明責任論中,證明責任的概唸是基礎中的基礎。證明責任論從＂嚴禁入內＂的動盪年代到＂備受關註＂的興起時代,走過瞭艱難的路程。然而,學術研究中的證明責任概唸還沒有得到十分明確,目前已經齣現證明責任論研究較少的現象。證明責任中隱含很多相對獨立的概唸,這些概唸的模糊性已經影響證明責任論的長足髮展,更是嚴重影響司法審判的公正性。通過對證明責任的本質、意義與作用的分析與研究,把隱含在證明責任概唸中的所有的獨立現象逐一明確併在訴訟中重新定位。

The concept of burden of proof is the basic essence of The Burden of Proof. The Burden of Proof has traveled a tough road from the ＂ no entry＂ age of turbulence to the ＂closely concerned＂ era of rising. However, the concept of ＂burden of proof＂ has not yet been clearly defined in academic research. But now The Burden of Proof has seen a depression. The burden of proof include many relatively independent concepts, but the ambiguity of which has already impacted the long-run development of the The Burden of Proof and seriously damaged judicial justice. This thesis will confirm all independent phenomena hidden in the concept of burden of proof one by one and redefine them in judicial proceedings by analyzing and studying the nature, meanings and effects of the burden of proof.
