专利创造性判断过程中引入客观性因素，落实整体评价原则，使得专利创造性判断的结果更趋真实地反映人类科技的进步，并且使判断结果具有相对的可重复性和稳定性，是专利法及专利制度的应有之义。创造性判断中的整体性原则是适应创造性客体系统性内在需要的必然选择，是实现创造性判断客观化的内在构成部分与重要保障机制。基于我国专利判断实践案例的实证研究显示，区别技术特征效果、常规试验能力等因素是重要的判别点，并据此构造了创造性判断模型。
專利創造性判斷過程中引入客觀性因素，落實整體評價原則，使得專利創造性判斷的結果更趨真實地反映人類科技的進步，併且使判斷結果具有相對的可重複性和穩定性，是專利法及專利製度的應有之義。創造性判斷中的整體性原則是適應創造性客體繫統性內在需要的必然選擇，是實現創造性判斷客觀化的內在構成部分與重要保障機製。基于我國專利判斷實踐案例的實證研究顯示，區彆技術特徵效果、常規試驗能力等因素是重要的判彆點，併據此構造瞭創造性判斷模型。

The introduction of objective factors in the process of judgment of patent inventive step and the implementation of the principle of judgment with integrity to make the results of the judgment of patent inventive step more truly reflect technological progress and relatively repeat- able and stable are the proper meanings of patent law and patent system. The principle of judg- ment with integrity in inventive step is the inevitable choice in terms of the adaption to systematic intrinsic needs of the creative objects, and also the intrinsic component ~ important guarantee mechanism of the objectivity of creation judgment. Empirical research based on China＇s patent judgment case studies shows that technical characteristics, conventional test ability and other factors are the key discrimination points, and a creation judgment model could be established accord- ingly.
