目前我国大量出现的非法持有有毒有害食品行为,仅仅依靠行政和经济制度对其进行约束是远远不够的,其社会危害性已达到了犯罪的程度,只有通过在刑法中设立＂非法持有有毒有害食品罪＂来打击这些非法牟利者,才能够从根本上遏制为非法牟利而不惜危害公共安全和经济秩序的恶劣行为。从犯罪构成要件来看,该罪的犯罪主体是自然人和单位,主观方面是直接故意,客体是公共安全和经济秩序,客观方面表现为将有毒有害食品作为原材料投入生产,为用于销售或用于经营性服务而非法持有有毒有害食品。

Enormous behaviors of illegal possession of toxic and hazardous food can no longer be re- strained by the administrative and economic system, its serious social harm has reached an unprece- dented level of crime. Such behavior of making profit illegally at the cost of the public security and e- conomic order can only be prevented effectively by setting up ＂crime of illegally possessing toxic and hazardous food＂.From the prospector of constitutive elements of crime,the subject of crime is natural person and unit with direct intention, and the object is the public safety and economic order, objective aspect is illegal possessing toxic and hazardous food with the purpose of using it as raw material for production,or for sale or other business service matters.
