西汉法家在儒术得到独尊、成为国家意识形态的情况下，并不甘心处于非主流的位置，而是千方百计地争夺意识形态话语权。他们批评儒家思想对安国尊君毫无用处，批评儒家没有执政能力和儒者人品低下，宣扬法治的必要，称颂先秦法家人物。但法家最终还是失败了，究其原因，一是法家只讲功利，不讲情义；二是强调“富国”而主张“弱民”；三是与众为敌，不能形成统一战线。
서한법가재유술득도독존、성위국가의식형태적정황하，병불감심처우비주류적위치，이시천방백계지쟁탈의식형태화어권。타문비평유가사상대안국존군호무용처，비평유가몰유집정능력화유자인품저하，선양법치적필요，칭송선진법가인물。단법가최종환시실패료，구기원인，일시법가지강공리，불강정의；이시강조“부국”이주장“약민”；삼시여음위활，불능형성통일전선。
Though Confucianism was worshipped alone,and turned into a national ideology,the legalists of the Western Han Dynasty were not satisfied with their non-mainstream position,but spared no efforts to fight for the ideological discourse.They criticized that Confucianism is of no use in stabilizing the country and worshipping the monarch,and that the Confucianists possessed no governing capacity and they were morally corrupt.They propagated the necessity of the rule of law,eulogized the legalists of the Pre-Qin Period.In the end,the legalists failed all the same.As for the reason,first of all,the legalists attached great importance to utility,ignoring the kindness.Second,they stressed “enriching the country”and“weakening the people”.Finally,they took other academic schools as enemies so that they could not stand as a united front.
