美国对高校师生不正当关系的规制分为三个层次:对性侵犯行为,国家以刑法进行规制,遵循谦抑原则;对性骚扰行为,国家和社会以民法、行政监督、申诉等方式进行多元规制,遵循契约原则;对合意性关系,由高校与教师共同体,依据规章或职业伦理进行规制,遵循自治原则。

There are three levels in the regulation of university Faculty-Student improper relationships in American. For sexual offenses, the states regulate it with criminal law following the principle of modesty;For sexual harassment, the state and society regulate it with civil law, administrative supervision, and appeal system, following the principle of contract; For Consensual sexual relationships, the community of university and teachers regulate it following the principle of autonomy. The experience of American has important enlightenment to China.
