美国对高校师生不正当关系的规制分为三个层次：对性侵犯行为，国家以刑法进行规制，遵循谦抑原则；对性骚扰行为，国家和社会以民法、行政监督、申诉等方式进行多元规制，遵循契约原则；对合意性关系，由高校与教师共同体，依据规章或职业伦理进行规制，遵循自治原则。

미국대고교사생불정당관계적규제분위삼개층차：대성침범행위，국가이형법진행규제，준순겸억원칙；대성소우행위，국가화사회이민법、행정감독、신소등방식진행다원규제，준순계약원칙；대합의성관계，유고교여교사공동체，의거규장혹직업윤리진행규제，준순자치원칙。
There are three levels in the regulation of university Faculty-Student improper relationships in American. For sexual offenses, the states regulate it with criminal law following the principle of modesty;For sexual harassment, the state and society regulate it with civil law, administrative supervision, and appeal system, following the principle of contract; For Consensual sexual relationships, the community of university and teachers regulate it following the principle of autonomy. The experience of American has important enlightenment to China.
