“依法管档”研究的主要内容与特征可以概括地表述为“依法管档”含义丰富，但专指性较弱；在相关文献中提及者众，论及者寡，专论者无；“依法管档”多与“依法治档”同时使用，均被视为档案部门的职责与任务：“依法管档”广泛运用于各行各业；强调“依法管档”需要法制观念与法制思维。同时，“依法管档”在研究与实践中也存在一定的问题，即“依法管档”及相关词组没有明确的界定，使用随意；《档案法》被赋予了法律之外的期望；更多地强调行政执法与行政执法权；寄期望于通过宣传教育提升全社会的普遍守法意识，这应当引起我们的重视。此外，为便于今后研究的开展，文章对“依法治档”、“依法管档”和“依法用档”三个概念做出界定。

At the same time, there are some problems for the ＂managing archives upon the rule of law＂ in research and practice, such as ＂ managing archives upon the rule of law ＂and related phrases were not clearly defined, and the phrase was free to use; the ＂Archives Act＂ was given the expectations outside the law; the archival departments put more emphasis on the administrative law enforcement and administrative law enforcement; The archival departments expect through publicity and education to enhance the society＇s universal law-abiding consciousness. The above-mentioned issues should arouse our attention.
