目前,我国以生产者环境责任制度为环境责任的主要组成部分,而信贷机构对其注入资金的项目造成的环境破坏后果则无需承担过多的环境责任.对于信贷机构对其注入资金的项目造成的环境破坏后果是否应该承担环境责任的问题,虽然我国出台了一系列绿色信贷的政策和文件,但是大多属于倡议性文件.将信贷机构纳入环境责任主体的范畴,既是实现环境正义的必然要求,也是生态文明建设和依法治国的新要求.信贷机构环境责任制度的构建是一个系统工程,它既需要银行业信贷机构履行绿色信贷义务,也需要完善银行业信贷机构的环境法律责任,并辅之以相应的监督及配套措施.

At present in China, manufacturers are the subject to shoulder the corresponding environment liability, while the credit institutions may take no consequence for any environ- mental damage. Although series of policies for ＂green credit＂ have been issued, most of them are advocacy documents. To take the credit institutions as the liability subject is the necessity to realize environment justice, and the new requirement of eco-civilization construc- tion and governing the country by law. The establishment of banking credit institution lia- bility system depends not only on the liability fulfillment by the institutions, but also on the perfection of detailed legal regulations for the credit institutions, and relevant supervision and countermeasures as well.
