人内在的发展天性总希冀于更美好的发展与自由的获得，而现代国家的要义之一亦在于追求人民福祉与社会进步，一定社会经济条件下内外相生的发展动因将为人权的确立和发展提供物质基础，并通过进一步的法律权利构建，为其提供真实有效的保障。随着我国社会经济的发展，有必要将公民在公共健康领域的各种权利、特权、权力和豁免以霍菲尔德式的展开加以梳理，厘清现行主要公共卫生法律中公民法律利益的诸多形态，并对其中有关公民法律权利的规范和内容进行梳理、重构，以构建法律权利意义上的公共健康获益权，最终促进公民健康水平的提高和全面发展的实现。
人內在的髮展天性總希冀于更美好的髮展與自由的穫得，而現代國傢的要義之一亦在于追求人民福祉與社會進步，一定社會經濟條件下內外相生的髮展動因將為人權的確立和髮展提供物質基礎，併通過進一步的法律權利構建，為其提供真實有效的保障。隨著我國社會經濟的髮展，有必要將公民在公共健康領域的各種權利、特權、權力和豁免以霍菲爾德式的展開加以梳理，釐清現行主要公共衛生法律中公民法律利益的諸多形態，併對其中有關公民法律權利的規範和內容進行梳理、重構，以構建法律權利意義上的公共健康穫益權，最終促進公民健康水平的提高和全麵髮展的實現。

The endogenous nature of development of human beings always anticipates better developments and more freedom. Meanwhile, one of essences of the modern state is to pursue people’s well-being and social progress. Only when these hopes coordinate with socio-economic conditions appropriately, could the transformation from ideas into the real world be achieved and could they provide solid material basis for new human rights. Nowadays, with the fast development of society and economy of China, it is necessary and possible to sort out all of these rights, privileges, powers and immunities in public health laws by Wesley N. Hohfeld’s legal concept theory. It could help us to have a deeper understanding of the legal rights and legal interests in this field. On this basis, by further clarifying, reinterpreting and reconstructing these legal interests, we could take the leap from human rights to legal rights, ultimately contributing to the improvement of the health of the citizens and the overall development.
