作为第一起中国承包商因在海外承包项目向ICSID提起的国际投资仲裁，北京城建集团诉也门共和国案具有里程碑意义。然而，提交ICSID仲裁需满足有关争议是直接因投资而产生的法律争议、投资者母国和东道国都是公约缔约国以及争议当事人同意将争议提交ICSID管辖三个条件。本文就该案是否可以提交Ic—slD仲裁从三个方面进行了分析。在此基础上，还分析了本案申请ICSID仲裁的理由。认为能否取得管辖权是本案能否付诉诸ICSID仲裁解决的关键。如果未来本案能进入实体审理，北京城建集团可以依据双边投资协定中的征收条款据理力争，要求“充分、及时、有效”的补偿。

The Case of Beijing Urban Construction Group Co. Ltd. v. Repub- lic of Yemen is the first one in which a Chinese contractor has lodged a com- plaint with ICSID for arbitration in the field of overseas projects contracting. However, a case submitted for ICSID arbitration should fulfill three conditional prerequisites. This paper conducts a feasibility analysis on whether the said case is valid for submission for ICSID arbitration from the perspectives of the three prerequisites. The reasons for seeking ICSID arbitration are also analyzed, con- eluding that rights of jurisdiction are the key factor deciding whether the case is suitable for ICSID arbitration. This paper believes that Beijing Urban Construc- tion Group may claim ＂complete, timely and effective＂ compensations based on the expropriation clauses in the bilateral investment agreement.
