检察机关由于其特殊的属性,更侧重于在刑事方面行使诉讼监督的职权,易使民事诉讼领域的检察监督受到忽视。民事诉讼法有关检察监督的修改体现了全面监督的原则,但监督的形式、方法、范围、程序等规定却较为粗疏。明确检察权的性质,分析其存在的合法性和正当性,充分发挥检察机关对于裁判行为、执行行为,以及相关违反法律要求的行为之监督作用,可以推动构建全面的民事检察监督体系,达到法律监督的预期和实效。

Owing to its special attribute,the procuratorial organ attaches more importance to exercising supervision in criminal lawsuit and tends to overlook its procuratorial supervision in civil lawsuit.The principle of overall supervision is embodied in the amendment of civil procedure law,but the provisions concerning its form,method,scope,procedure etc.are relatively rough.So if we make clear the nature of procuratorial power,analyze the legality and legitimacy of its existence,and give full play to the supervision of the procuratorial organ in judgement,execution and other violations of law,we can promote the construction of a comprehensive civil procuratorial supervision system and achieve the expectation and effectiveness of legal supervision.
