我国刑法关于环境污染犯罪的＂结果本位＂的传统立法观念严重制约了对当前环境风险的防范及其有效治理,难以对污染环境危险行为做出有效规制。顺应＂犯罪化＂、＂处罚早期化＂等国际刑事立法潮流,学习借鉴日本、美国等发达国家的立法经验,认为我国刑法应当对污染环境罪进行扩张处罚,将污染环境危险行为犯罪化,即在《刑法》第338条的基础上增设污染环境罪危险犯的基本犯罪形态,实现刑法对环境污染防控的前置保护。
아국형법관우배경오염범죄적＂결과본위＂적전통입법관념엄중제약료대당전배경풍험적방범급기유효치리,난이대오염배경위험행위주출유효규제。순응＂범죄화＂、＂처벌조기화＂등국제형사입법조류,학습차감일본、미국등발체국가적입법경험,인위아국형법응당대오염배경죄진행확장처벌,장오염배경위험행위범죄화,즉재《형법》제338조적기출상증설오염배경죄위험범적기본범죄형태,실현형법대배경오염방공적전치보호。
The traditional legislative concept of＂result-orientation＂on the crime of environmental pollution in China＇s criminal law has seriously restricted current environmental risk prevention and its effective governance,which makes it difficult to regulate dangerous act of environmental pollution effectively.Going with such international tide of criminal legislation as＂criminalization＂and＂early punishment＂and using for reference the legislative experience of such developed countries as Japan and the United States,the author believes that the punishment for the crime of environmental pollution should be expanded by our criminal law and the dangerous act of environmental pollution should be criminalized.That is,the basic crime patterns of potential damage offence of environmental pollution should be added to article 338 of the Criminal Lawin order to privide advance protection for the environmental pollution prevention and control.
